The criminal justice system has multiple roles to play in the relationship amongst the state, society and the individual According to two important postulates of modern political theory the society's interest is the collective interest of its individuals and the State is an instrument of the society. The existing criminal justice system appears to have vehemently failed to deliver the goods in the real sense as a result of which the general people's confidence in the transparent functioning of the judicial system is constantly being shaken. The present study makes an humble attempt to look into the issue of criminal justice system in India highlighting its efficacy and relevance in the present society.
